Hometrino Terms of Use

By accessing, browsing, creating an account, submitting information, or otherwise using the Hometrino website or any related pages, tools, features, or services (collectively, the "Platform"), you agree to these Terms of Use ("Terms").
If you are using the Platform on behalf of a company, brokerage, team, or other organization, you confirm that you have authority to bind that organization to these Terms. In that case, "you" includes both you and that organization.
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date above. Your continued use of the Platform after updates become effective means you accept the updated Terms.
2. Definitions and Hometrino's Role
2.1 Definitions
For clarity, the following terms have the meanings below:
- "Hometrino," "we," "us," or "our" means Hometrino, LLC.
- "Platform" means the hometrino.com website and any related pages, tools, features, communications, and services we make available, including any future mobile applications.
- "User," "you," or "your" means any person or entity that accesses or uses the Platform.
- "Listings" means property listings and related information that may be displayed on the Platform, including listing status, price, photos, descriptions, property features, and other details.
- "Content" means text, photos, images, video, audio, data, software, code, designs, and other materials made available through the Platform, including Listings.
- "Professional" means a real estate agent, broker, team, property manager, landlord, lender, or other service provider who uses the Platform, including through any agent portal or professional account features.
- "Third-Party Provider" means any third party that provides services, content, tools, data, or integrations that appear on or are linked from the Platform.
2.2 Hometrino's Role
Hometrino operates a real estate information and marketing Platform. The Platform may help users research properties and connect with real estate professionals, but Hometrino does not:
- provide real estate brokerage services (unless explicitly stated on a specific page),
- act as a buyer's agent, seller's agent, landlord's agent, or dual agent,
- participate as a party in any transaction, or
- guarantee that any real estate transaction will occur or close.
Any decision to buy, sell, rent, lease, finance, or otherwise transact in real estate is made solely by you and the relevant third parties involved in that transaction.
No Professional Advice
The Platform is provided for general informational purposes only. Hometrino does not provide legal, tax, financial, appraisal, insurance, lending, or investment advice. While the content is drafted by experts, it is provided for informational purposes only. You should consult qualified professionals for advice specific to your situation.
Advertising and Monetization
The Platform may include advertisements and may facilitate connections between users and Professionals. Hometrino may receive compensation related to advertising, placement, or lead delivery. Compensation does not imply endorsement, verification, or a recommendation of any Professional or service.
3. Listing Information, Data Sources, MLS/IDX, and Verification Obligations
3.1 Sources of Listing Information
Property listings and related information displayed on the Platform may be obtained from a variety of sources, including but not limited to:
- Multiple Listing Services ("MLS")
- Internet Data Exchange ("IDX") feeds
- Licensed real estate brokers and agents
- Property owners and managers
- Public records and governmental databases
- Third-party data aggregators and vendors
Listing information may include, without limitation:
- Property status (active, pending, sold, withdrawn, etc.)
- Listing price and price history
- Property descriptions
- Photographs and media
- Square footage and lot size
- Bedroom and bathroom counts
- Taxes, HOA dues, and fees
- School information
- Zoning classifications
- Geographic location and mapping data
- Estimated values or analytics
Hometrino does not independently verify all information received from these sources.
3.2 No Guarantee of Accuracy or Completeness
All Listing information is provided on an "as received" basis from third-party sources. While we aim to display current and accurate data, you acknowledge and agree that:
- Listing data may contain errors, omissions, inaccuracies, or typographical mistakes.
- Property status may change before updates appear on the Platform.
- Listings may be sold, rented, withdrawn, or modified without notice.
- Pricing information may not reflect recent changes.
- Public record information may be outdated or incomplete.
Hometrino does not guarantee that any Listing information is accurate, complete, reliable, or current.
3.3 User Responsibility to Independently Verify
You are solely responsible for independently verifying any information before relying on it for:
- Purchase decisions
- Sale decisions
- Lease agreements
- Financing arrangements
- Property valuations
- Investment decisions
Verification may include contacting:
- The listing broker
- The property owner
- A licensed real estate professional
- Local government offices
- Inspectors, appraisers, surveyors, or other qualified experts
You agree that you will not rely solely on information displayed on the Platform.
3.4 MLS and IDX Content Acknowledgment
Certain Listings are provided through MLS and IDX feeds and are subject to MLS rules and regulations. You acknowledge and agree that:
- MLS data is deemed reliable but not guaranteed.
- The applicable MLS organization retains ownership and proprietary rights in its database.
- MLS participants and authorized representatives may monitor the Platform for compliance with MLS display rules.
- You will use MLS/IDX data solely for personal, non-commercial purposes related to evaluating potential real estate transactions.
You may not:
- Copy, reproduce, scrape, republish, distribute, or sell MLS/IDX content.
- Use automated tools to harvest MLS/IDX data.
- Use MLS/IDX data for commercial analytics, resale, or competing services.
3.5 Data Latency and Feed Delays
You understand that Listing information is transmitted via automated feeds and technical systems. There may be delays in:
- Status updates
- Price changes
- New listings appearing
- Listings being removed
Hometrino is not responsible for discrepancies caused by data transmission delays, synchronization issues, technical interruptions, or third-party feed disruptions.
3.6 Property Estimates, Analytics, or Calculations
If the Platform displays estimated values, automated analytics, or calculated metrics:
- Such estimates are generated through automated models.
- They are not appraisals.
- They are not professional valuations.
- They should not be relied upon for lending, investment, or pricing decisions.
- Actual market value may differ significantly.
3.7 No Offer to Sell or Solicit
The display of a Listing on the Platform does not constitute an offer to sell, a binding solicitation, or a guaranteed availability. All real estate transactions are subject to negotiation, contractual agreement, and compliance with applicable laws.
3.8 Third-Party Mapping and Location Data
Mapping features and location information may be provided by third-party providers. Location accuracy is not guaranteed and may vary due to GPS inaccuracies, public record inconsistencies, and geocoding limitations. Hometrino is not responsible for geographic misplacements.
3.9 School and Community Information
School boundaries, ratings, and community information displayed on the Platform may be provided by third parties. School attendance zones and ratings may change. You are responsible for verifying school assignments directly with the relevant school district.
4. Eligibility, User Accounts, Registration, and Security
4.1 Eligibility to Use the Platform
You may use the Platform only if:
- You are at least eighteen (18) years of age;
- You have the legal capacity to enter into a binding agreement; and
- Your use of the Platform complies with all applicable local, state, and federal laws.
If you are using the Platform on behalf of a business entity, brokerage, team, or organization, you represent and warrant that you have authority to bind that entity to these Terms.
Hometrino reserves the right to refuse access to any person or entity at its discretion, subject to applicable law.
4.2 Account Registration
Certain features of the Platform may require account registration, including consumer accounts and Professional accounts. When registering for an account, you agree to:
- Provide accurate, current, and complete information;
- Maintain and promptly update your information if it changes;
- Provide truthful identity and contact information;
- Not create accounts under false or misleading identities.
We may require additional verification for Professional accounts, including proof of licensing or other credentials.
4.3 Professional Account Representations
If you register or use the Platform as a Professional, you represent and warrant that:
- You hold all licenses required by law to provide your services;
- Your license is active and in good standing;
- You will comply with all applicable licensing laws, regulations, and ethical obligations;
- All information you provide about your services, experience, or credentials is truthful and not misleading;
- You are solely responsible for the services you provide to consumers.
Hometrino does not supervise, direct, or control the professional activities of agents, brokers, or other Professionals using the Platform.
4.4 Account Credentials and Security
You are responsible for maintaining the confidentiality of your login credentials, including your username and password. You agree:
- Not to share your login credentials with others;
- Not to allow unauthorized access to your account;
- To notify Hometrino promptly if you suspect unauthorized access or misuse.
You are responsible for all activity that occurs under your account, whether or not authorized by you.
4.5 Account Use Restrictions
You may not:
- Transfer or sell your account to another party;
- Use another person's account without authorization;
- Create multiple accounts to evade restrictions or suspension;
- Use the Platform to impersonate another individual or entity.
4.6 Account Monitoring and Verification
Hometrino may, but is not obligated to:
- Monitor account activity;
- Investigate suspected violations;
- Request verification of identity or credentials;
- Suspend or limit accounts pending investigation.
Failure to provide requested verification information may result in account suspension or termination.
4.7 Suspension and Termination of Accounts
Hometrino may suspend, restrict, or terminate your access to the Platform at any time, with or without notice, if we determine, in our sole discretion, that:
- You have violated these Terms;
- You have engaged in unlawful conduct;
- Your use poses a risk to other users or to the Platform;
- Your Professional license has lapsed, been suspended, or been revoked;
- You have provided false or misleading information.
Suspension or termination may include removal of Listings or profile content, loss of access to leads, and deletion of account data, subject to our Privacy Policy. Hometrino shall not be liable for any losses arising from suspension or termination.
4.8 Account Deactivation
You may request account deactivation by contacting support@hometrino.com. Deactivation does not relieve you of obligations incurred prior to termination.
5. License Grant, Permitted Use, and Prohibited Conduct
5.1 Limited License to Use the Platform
Subject to your compliance with these Terms, Hometrino grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the Platform solely for:
- Personal, non-commercial real estate research; and
- Lawful professional activities (if you are a Professional) consistent with these Terms.
This license does not grant you ownership of any Content or intellectual property displayed on the Platform. All rights not expressly granted are reserved by Hometrino.
5.2 Personal and Non-Commercial Use Limitation
Unless expressly authorized in writing by Hometrino, you may use the Platform only for personal, non-commercial purposes related to evaluating potential real estate transactions. You may not use the Platform:
- For resale of data;
- For commercial data mining or analytics;
- For generating leads for competing services;
- For training artificial intelligence systems using Platform data;
- For any purpose unrelated to legitimate real estate research or services.
5.3 Prohibited Automated Access and Data Extraction
You may not access or use the Platform through automated means without our prior written consent. Prohibited automated activities include, but are not limited to:
- Scraping
- Data harvesting
- Spidering
- Use of bots or scripts
- Bypassing CAPTCHA or rate limits
- Automated querying of databases
- Programmatic extraction of listing data
You may not attempt to circumvent any technical measures designed to prevent automated access. Hometrino reserves the right to implement technical, legal, and contractual measures to prevent unauthorized automated access.
5.4 No Reverse Engineering or Interference
You may not:
- Reverse engineer, decompile, or disassemble any part of the Platform;
- Attempt to derive source code;
- Probe, scan, or test vulnerabilities;
- Interfere with security features;
- Introduce malware, viruses, or harmful code;
- Overload, flood, or disrupt servers or networks;
- Attempt unauthorized access to user accounts, data, or administrative systems.
5.5 No Competitive Use
You may not access or use the Platform for the purpose of:
- Building or improving a competing product or service;
- Replicating the Platform's functionality;
- Benchmarking the Platform for competitive analysis;
- Extracting Listings for use on another website or application.
Use of Platform Content for the development of a competing real estate search, listing display, or lead-generation platform is strictly prohibited.
5.6 Fair Housing and Anti-Discrimination Compliance
You agree not to use the Platform in any way that violates federal, state, or local fair housing laws. You may not:
- Express preferences or limitations based on protected characteristics;
- Use the Platform to facilitate discriminatory practices;
- Post or transmit discriminatory content.
Hometrino may remove content or suspend accounts that violate fair housing principles.
5.7 No Misrepresentation or Impersonation
You may not:
- Impersonate any person or entity;
- Misrepresent your identity, credentials, or affiliation;
- Falsely claim endorsement or partnership with Hometrino;
- Create accounts using false information.
5.8 No Unlawful or Harmful Use
You may not use the Platform to:
- Violate any law or regulation;
- Engage in fraud or deception;
- Harass, threaten, or harm others;
- Transmit unlawful, abusive, defamatory, or obscene material.
5.9 Monitoring and Enforcement
Hometrino reserves the right, but not the obligation, to monitor use of the Platform, investigate suspected violations, restrict, suspend, or terminate access, and pursue legal remedies for misuse. We may cooperate with law enforcement authorities where appropriate.
5.10 Remedies for Unauthorized Use
Unauthorized access or misuse of the Platform may result in:
- Immediate account termination;
- Blocking of IP addresses;
- Revocation of access rights;
- Legal action for damages, injunctive relief, or other remedies.
You acknowledge that unauthorized scraping or misuse may cause irreparable harm to Hometrino and that monetary damages alone may not be a sufficient remedy.
6. Professional and Agent-Specific Terms
This Section applies to any real estate agent, broker, team, property manager, landlord, lender, or other professional ("Professional") who creates an account, receives inquiries, or otherwise uses the Platform in a professional capacity.
6.1 Independent Professional Status
Professionals using the Platform are independent businesses and are not employees, partners, joint venturers, or agents of Hometrino. Nothing in these Terms creates an employment relationship, a brokerage relationship, a partnership or joint venture, or an agency relationship between Hometrino and any Professional. Professionals are solely responsible for their services, representations, and compliance with applicable laws.
6.2 Licensing and Legal Compliance
By using the Platform as a Professional, you represent and warrant that:
- You hold all required professional licenses for the jurisdictions in which you operate;
- Your licenses are active and in good standing;
- You will comply with all applicable federal, state, and local laws;
- You will comply with fair housing, anti-discrimination, advertising, and disclosure laws;
- You will comply with MLS and brokerage regulations applicable to you.
You agree to promptly notify Hometrino if your professional license becomes suspended, revoked, restricted, or otherwise not in good standing. Hometrino may request proof of licensing at any time.
6.3 Lead Delivery and No Guarantee
The Platform may deliver consumer inquiries or contact requests ("Leads") to Professionals. You acknowledge and agree that:
- Hometrino does not guarantee the number, frequency, quality, or conversion rate of Leads.
- Leads may be shared with more than one Professional unless otherwise specified.
- A Lead may not result in a transaction.
- Hometrino does not verify the identity, intent, or financial capability of users submitting inquiries.
- All Leads are provided "as is" without warranty of accuracy or completeness.
6.4 Professional Responsibility for Communications
Professionals are solely responsible for all communications with users, representations made to users, advice or services provided, and compliance with telemarketing, anti-spam, and consumer protection laws. Hometrino does not monitor or control communications between Professionals and consumers, except where required for compliance or technical operation.
6.5 Marketing and Profile Content
Professionals may be permitted to create profile pages and upload photos, biographies, credentials, and marketing materials. You represent and warrant that:
- All content you submit is accurate and not misleading;
- You have the right to use any images or materials uploaded;
- Your profile does not violate intellectual property rights;
- Your marketing content complies with advertising laws and brokerage regulations.
Hometrino reserves the right to edit, remove, or reject Professional content at its discretion.
6.6 No Endorsement or Guarantee
Hometrino does not endorse any Professional, guarantee performance, skill, or ethical conduct, or verify every representation made by a Professional. Users are responsible for independently evaluating Professionals before engaging their services.
6.7 Fees and Compensation
If Hometrino offers paid promotional features, advertising, or enhanced placement in the future, additional written terms may apply. Unless otherwise specified in a separate agreement, Hometrino does not charge consumers for basic use of the Platform, and any compensation arrangements with Professionals will be governed by separate written agreements.
6.8 No Exclusive Territory or Referral Rights
Use of the Platform does not grant Professionals exclusive geographic territories, exclusive access to Listings, exclusive rights to consumer inquiries, or ownership of Platform-generated consumer relationships. Hometrino reserves full discretion regarding lead routing and Platform operation.
6.9 Professional Indemnification
Professionals agree to indemnify and hold harmless Hometrino from any claims arising out of services provided to consumers, alleged misrepresentation, licensing violations, fair housing violations, transaction disputes, and advertising claims made by the Professional.
6.10 Removal of Professional Accounts
Hometrino may suspend or remove Professional accounts if licensing lapses, Professional conduct harms users, false information is provided, legal or regulatory concerns arise, or the Professional violates these Terms. Hometrino shall not be liable for any loss of business resulting from removal.
7. User-Generated Content and Content License
7.1 Definition of User-Generated Content
"User-Generated Content" ("UGC") means any content that a User or Professional submits, uploads, posts, transmits, or otherwise makes available through the Platform, including but not limited to:
- Profile information
- Biographies
- Photos and videos
- Logos and branding materials
- Comments or feedback
- Messages submitted through forms
- Reviews (if enabled)
- Property-related materials
- Marketing content
UGC does not include Listing data provided directly through MLS/IDX feeds unless separately uploaded by a user.
7.2 Ownership of User Content
You retain ownership of any UGC that you submit. However, by submitting UGC to the Platform, you grant Hometrino a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, display, reproduce, modify for formatting purposes, distribute, publicly perform, and publicly display your UGC in connection with operating, improving, promoting, and maintaining the Platform. This license continues for as long as your UGC remains on the Platform.
7.3 Representations and Warranties Regarding UGC
By submitting UGC, you represent and warrant that:
- You own the content or have the necessary rights to submit it;
- The content does not infringe intellectual property rights;
- The content does not violate privacy or publicity rights;
- The content complies with applicable laws;
- The content is not false, misleading, defamatory, obscene, or unlawful.
You are solely responsible for your UGC.
7.4 No Obligation to Publish
Hometrino is not obligated to publish or maintain any UGC. We may, in our sole discretion, remove content, edit content for formatting, refuse to publish content, or suspend accounts related to problematic content. We are not required to provide advance notice before removing UGC.
7.5 Content Moderation
Hometrino reserves the right, but not the obligation, to monitor UGC for compliance with these Terms. We may remove content that we determine, in our discretion, violates these Terms, violates applicable laws, exposes Hometrino to liability, or is harmful, abusive, deceptive, discriminatory, or fraudulent.
7.6 No Responsibility for User Content
Hometrino does not endorse, verify, or guarantee the accuracy of UGC. We are not responsible for statements made by Users or Professionals, misrepresentations in profiles, disputes arising from UGC, or damages resulting from reliance on UGC. You assume all risk associated with interacting with other Users.
7.7 Repeat Infringer Policy
In appropriate circumstances, Hometrino may terminate accounts of Users who repeatedly infringe intellectual property rights. We may restrict access to Users who violate copyright laws or these Terms.
7.8 Feedback
If you provide suggestions, ideas, or feedback regarding the Platform ("Feedback"), you grant Hometrino a perpetual, irrevocable, royalty-free right to use that Feedback without restriction or compensation.
8. Intellectual Property Rights
8.1 Ownership of the Platform
The Platform, including its design and layout, software and source code, databases and system architecture, user interfaces, graphics, logos, and branding elements, and text, compilations, and arrangements of content, is owned by Hometrino, LLC or its licensors and is protected by intellectual property laws, including copyright, trademark, and trade secret laws. Except for the limited license granted in Section 5, no rights are transferred to you.
8.2 Hometrino Trademarks
The name "Hometrino," the Hometrino logo, and all related names, logos, product and service names, designs, and slogans are trademarks or service marks of Hometrino, LLC. You may not:
- Use our trademarks without prior written consent;
- Use our brand in a manner that implies endorsement or affiliation;
- Register domain names or social media accounts containing confusingly similar names.
Unauthorized use of our trademarks may violate trademark laws.
8.3 Listing Content and Third-Party Intellectual Property
Property photos, descriptions, listing details, and MLS data may be owned by listing brokers, photographers, MLS organizations, data providers, or other third parties. Such content is displayed pursuant to agreements and is protected by applicable copyright and database rights laws. You may not:
- Copy or reproduce listing photos;
- Republish property descriptions;
- Download listing data in bulk;
- Use listing materials for commercial purposes;
- Remove watermarks or copyright notices.
Any permitted use must be strictly personal and non-commercial.
8.4 MLS and Database Rights
Certain Listings originate from MLS databases that retain proprietary rights in their data compilations. You acknowledge that MLS organizations hold intellectual property rights in their databases, the compilation of listing data is protected even if individual facts are not, and unauthorized copying or extraction may violate MLS agreements and database protection laws. Hometrino may enforce MLS compliance obligations, including technical restrictions and legal remedies.
8.5 No Implied License
Nothing on the Platform grants you ownership rights in Platform content, rights to use proprietary software, rights to exploit data for commercial use, or rights to sublicense Platform materials. Any rights not expressly granted are reserved.
8.6 Copyright Infringement (DMCA Policy)
Hometrino respects intellectual property rights and expects Users to do the same. If you believe that content on the Platform infringes your copyright, you may submit a notice including:
- Your physical or electronic signature;
- Identification of the copyrighted work claimed to be infringed;
- The specific URL or location of the allegedly infringing material;
- Your contact information;
- A statement of good-faith belief that the use is unauthorized;
- A statement under penalty of perjury that the information provided is accurate and that you are authorized to act on behalf of the copyright owner.

Hometrino may remove allegedly infringing material and may terminate repeat infringers. If you believe your content was removed in error, you may submit a counter-notification consistent with applicable copyright law.
8.7 Reservation of Rights
Hometrino reserves all rights not expressly granted in these Terms. Unauthorized use of Platform intellectual property may result in suspension, termination, and legal action.
9. Third-Party Services, Integrations, and External Links
9.1 Third-Party Content and Services
The Platform may include links to, integrations with, or content provided by third parties ("Third-Party Services"), including but not limited to mapping providers, communication service providers, analytics services, payment processors, advertising networks, public records providers, and MLS data vendors.
Third-Party Services are not owned or controlled by Hometrino. Hometrino does not endorse, control, or assume responsibility for the content of Third-Party Services, the accuracy of third-party information, the availability of external websites, or the business practices of third parties. Your interactions with Third-Party Services are solely between you and that third party.
9.2 Mapping and Location Tools
The Platform may use third-party mapping technologies to display property locations. Mapping data may contain inaccuracies, be approximate, and reflect geocoding estimates rather than surveyed boundaries. Hometrino does not guarantee geographic accuracy. Use of mapping features may be subject to the third party's own terms and policies.
9.3 Communications Services
The Platform may use third-party systems to route inquiries to Professionals, deliver emails, facilitate text messaging, route phone calls, and provide analytics or fraud prevention services. If call routing or tracking tools are used, call metadata such as date, time, and duration may be logged, communications may be recorded where permitted by law, and users will be notified where required by applicable law. Hometrino is not responsible for the performance, security, or reliability of third-party communication providers.
9.4 Advertising Networks
Advertisements displayed on the Platform may be served by third-party advertising partners. Such partners may use cookies or tracking technologies, collect anonymized data, and display interest-based advertisements. Advertising partners are governed by their own privacy policies.
9.5 Public Records and Data Vendors
Some property information may originate from public record databases or third-party data vendors. Public record data may be outdated, contain clerical errors, or reflect incomplete records. Hometrino does not independently verify public record data.
9.6 No Responsibility for Third-Party Transactions
If you engage with a Third-Party Provider through the Platform, including but not limited to real estate agents, brokers, property managers, lenders, inspectors, or title companies, Hometrino is not responsible for the quality of services provided, transaction outcomes, disputes between you and third parties, financial losses, or misrepresentations by third parties. You assume full responsibility for evaluating third parties before entering into any agreement.
9.7 Third-Party Terms Apply
Your use of Third-Party Services may be subject to additional terms and privacy policies imposed by those providers. It is your responsibility to review and comply with such third-party terms.
10. Privacy and Electronic Communications
10.1 Privacy Policy
Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, store, and disclose personal information. The Privacy Policy is incorporated into these Terms by reference and forms part of this agreement. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy.
10.2 Consent to Electronic Communications
By using the Platform, creating an account, or submitting contact information, you agree to receive communications from Hometrino electronically, including via email, text message (SMS or MMS), phone call, Platform notifications, and automated systems where permitted by law.
These communications may include responses to inquiries, account notifications, service-related messages, Platform updates, and administrative notices. You agree that electronic communications satisfy any legal requirement that communications be in writing.
10.3 Communications with Professionals
When you submit a form, request information, or otherwise indicate interest in a property or service, you consent to being contacted by relevant Professionals via phone call, text message, or email. Such communications may be made using automated technology where permitted by law.
If you do not wish to receive communications, you should not submit your contact information through the Platform. You may opt out of marketing emails by using the unsubscribe mechanism included in such communications.
10.4 Telephone and Text Messaging Consent
If you provide a phone number through the Platform, you represent that the number belongs to you or that you have authority to provide it, and you consent to receive calls and text messages related to your inquiry. Message and data rates may apply depending on your mobile carrier. Consent to receive communications is not a condition of purchasing any goods or services from Hometrino.
10.5 Recording and Monitoring
Where permitted by law, communications facilitated through the Platform may be recorded or logged for purposes including quality assurance, fraud prevention, system improvement, and compliance. Where required by applicable law, appropriate notice will be provided before recording.
10.6 Electronic Records and Signatures
You agree that electronic agreements and records are legally binding, electronic acceptance of these Terms constitutes a valid agreement, and you will not contest the legal validity of electronically delivered notices.
10.7 Opt-Out Rights
You may unsubscribe from marketing emails, contact support@hometrino.com to request communication preference adjustments, or disable certain browser notifications through your device settings. Administrative and service-related communications may still be sent as necessary for Platform operation.
11. Disclaimers of Warranties
11.1 Platform Provided "As Is" and "As Available"
THE PLATFORM AND ALL CONTENT, LISTINGS, DATA, AND SERVICES PROVIDED THROUGH THE PLATFORM ARE PROVIDED ON AN "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HOMETRINO DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
11.2 No Warranty of Accuracy or Reliability
Hometrino does not warrant that Listing information is accurate, complete, or current, property status is up to date, data is free from errors or omissions, public records are accurate, third-party information is reliable, or mapping or location information is precise. Any reliance on information obtained through the Platform is at your own risk.
11.3 No Warranty of Platform Availability
Hometrino does not warrant that the Platform will operate uninterrupted, access will be continuous or error-free, the Platform will be secure from unauthorized access, defects will be corrected immediately, or the Platform will be free of viruses or harmful components. We may modify, suspend, or discontinue the Platform at any time without notice.
11.4 No Warranty of Transaction Outcome
Hometrino makes no representations or guarantees regarding the successful purchase, sale, lease, or financing of any property, the qualifications or conduct of Professionals, the ability of a Professional to complete a transaction, or the financial capability of any user. All transactions are conducted solely between users and third parties.
11.5 No Professional Advice Warranty
Hometrino does not warrant that information provided through the Platform constitutes legal advice, financial advice, tax advice, insurance advice, appraisal or valuation services, or investment advice. Users are solely responsible for consulting appropriate licensed professionals.
11.6 Implied Warranties Disclaimed
To the maximum extent permitted by law, Hometrino disclaims all implied warranties, including merchantability, fitness for a particular purpose, non-infringement, quiet enjoyment, title, accuracy, and freedom from defects. Some jurisdictions do not allow certain warranty disclaimers. In such cases, disclaimers apply to the fullest extent permitted by law.
11.7 Third-Party Content Disclaimer
Hometrino is not responsible for content provided by Professionals, third-party services, advertisements, public record data, or MLS data accuracy. Third-party content is the responsibility of its respective provider.
11.8 Allocation of Risk
You acknowledge that use of the Platform is voluntary, you assume all risks associated with reliance on Platform information, and the disclaimers in this Section are a material part of this agreement.
12. Limitation of Liability
12.1 Exclusion of Certain Damages
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOMETRINO, LLC AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, BUSINESS OPPORTUNITY, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO:
- Your access to or use of the Platform;
- Your inability to access or use the Platform;
- Reliance on Listings or Content;
- Communications with Professionals or third parties;
- Errors, inaccuracies, or omissions in data;
- Unauthorized access to your account;
- Technical failures or interruptions;
- Any transaction or dispute between users and third parties.
This limitation applies regardless of the legal theory — contract, tort, negligence, strict liability, or otherwise — even if Hometrino has been advised of the possibility of such damages.
12.2 Cap on Total Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMETRINO'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE PLATFORM OR THESE TERMS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100) OR THE TOTAL AMOUNT PAID BY YOU TO HOMETRINO IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.
If you have not paid Hometrino any amounts, your exclusive remedy is to stop using the Platform.
12.3 Liability Related to Real Estate Transactions
Hometrino shall not be liable for failed transactions, misrepresentations by Professionals, property defects, contract disputes, earnest money disputes, inspection issues, appraisal outcomes, title defects, financing denials, or market fluctuations. All real estate transactions involve risk, and Hometrino is not a participant in such transactions.
12.4 Unauthorized Access and Security
Hometrino implements reasonable technical safeguards, but no system is completely secure. Hometrino shall not be liable for unauthorized access to user accounts, data breaches caused by third parties, loss of data due to system failures, or interception of communications.
12.5 Essential Basis of the Bargain
You acknowledge that the disclaimers and limitations of liability in these Terms are a fundamental part of the agreement between you and Hometrino, and that without these limitations, the Platform would not be provided on the same terms.
12.6 Jurisdictional Limitations
Some jurisdictions do not allow certain exclusions or limitations of liability. In such jurisdictions, Hometrino's liability shall be limited to the maximum extent permitted by applicable law.
13. Indemnification
13.1 General Indemnification Obligation
You agree to defend, indemnify, and hold harmless Hometrino, LLC and its owners, officers, directors, employees, contractors, agents, affiliates, licensors, and service providers (collectively, the "Hometrino Parties") from and against any and all claims, demands, actions, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees and court costs, arising out of or relating to:
- Your access to or use of the Platform;
- Your violation of these Terms;
- Your violation of any applicable law or regulation;
- Your infringement of intellectual property rights;
- Your User-Generated Content;
- Your interactions or transactions with other users or third parties;
- Your professional services (if you are a Professional).
13.2 Professional-Specific Indemnification
If you are a Professional, you further agree to indemnify and hold harmless the Hometrino Parties from any claims arising from alleged misrepresentation of property information, breach of fiduciary duty, licensing violations, fair housing violations, advertising violations, contract disputes with clients, claims related to commissions or compensation, and alleged negligence in providing professional services. Hometrino shall not be responsible for the acts, omissions, or professional conduct of any Professional using the Platform.
13.3 Defense and Cooperation
Hometrino reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification. If Hometrino exercises this right, you agree to cooperate in the defense, you may not settle any claim without Hometrino's prior written consent, and Hometrino may participate in settlement negotiations.
13.4 Survival
Your indemnification obligations survive termination of your account and the continued effect of these Terms.
14. Governing Law and Dispute Resolution
14.1 Governing Law
These Terms and any dispute arising out of or relating to the Platform shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law principles.
14.2 Agreement to Arbitrate
Except for claims eligible for small claims court or claims seeking injunctive relief related to intellectual property, you and Hometrino agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Platform, your use of the Platform, any Listings or Content, or any communications or interactions facilitated by the Platform shall be resolved exclusively through binding arbitration, rather than in court.
14.3 Arbitration Procedure
Arbitration shall be conducted on an individual basis, administered by a nationally recognized arbitration organization, conducted in the State of Florida unless otherwise required by law, and governed by the Federal Arbitration Act. The arbitrator shall have authority to award damages or relief available under applicable law, subject to the limitations set forth in these Terms.
14.4 Class Action Waiver
You and Hometrino agree that arbitration shall be conducted only on an individual basis, neither party may bring claims as a plaintiff or class member in a class, collective, representative, or consolidated action, and the arbitrator may not consolidate claims of multiple parties. You expressly waive any right to participate in a class action lawsuit or class-wide arbitration.
14.5 Jury Trial Waiver
To the extent any dispute proceeds in court rather than arbitration, you and Hometrino waive any right to a jury trial.
14.6 Exceptions
Nothing in this Section prevents either party from filing an individual claim in small claims court or seeking temporary or preliminary injunctive relief in court to prevent unauthorized use of intellectual property or confidential information.
14.7 Time Limitation for Claims
Any claim arising out of or relating to the Platform must be filed within one (1) year after the cause of action arises. After that time, the claim is permanently barred to the fullest extent permitted by law.
14.8 Survival
This dispute resolution provision survives termination of these Terms and your use of the Platform.
15. Miscellaneous Provisions
15.1 Entire Agreement
These Terms, together with the Privacy Policy and any additional written agreements expressly referenced herein, constitute the entire agreement between you and Hometrino regarding your use of the Platform. These Terms supersede all prior or contemporaneous communications, proposals, representations, or agreements, whether oral or written.
15.2 Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect. The invalidity of one provision does not affect the enforceability of any other provision.
15.3 No Waiver
Hometrino's failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or the right to enforce it later. Any waiver must be in writing and signed by an authorized representative of Hometrino.
15.4 Assignment
You may not assign, transfer, or delegate your rights or obligations under these Terms without prior written consent from Hometrino. Hometrino may assign or transfer these Terms, in whole or in part, at any time without restriction, including in connection with a merger, acquisition, corporate restructuring, or sale of assets.
15.5 Force Majeure
Hometrino shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to natural disasters, acts of government, internet service interruptions, power failures, cybersecurity incidents, labor disputes, pandemics, and third-party service outages.
15.6 Relationship of the Parties
Nothing in these Terms creates any partnership, joint venture, employment, agency, or fiduciary relationship between you and Hometrino. You acknowledge that Hometrino is an independent platform provider.
15.7 Survival
The following Sections survive termination of these Terms and your use of the Platform: Intellectual Property, User-Generated Content License, Disclaimers of Warranties, Limitation of Liability, Indemnification, Dispute Resolution, and Miscellaneous Provisions.
